I. Subject of the contract
These Terms & Conditions govern the rights and obligations of the parties arising in connection with the contract for the temporary provision of digital content (film rental), concluded between the operator and the viewer through the web interface at indiestream.cz.
The contract is concluded exclusively electronically – no written or signed document is required. The contract is concluded upon completion of the order, i.e. upon payment of the film access code. By completing the order, the viewer confirms that they have read and agree to these Terms & Conditions.
Services offered:
- Online film rental - temporary access to digital content
- Access period: monthly rental (30 days) from activation of the access code; for selected films also a 24-hour rental at a reduced price
- Number of devices: a rented film can be watched on up to two devices simultaneously
- Technical implementation: Streaming via a secure web interface
- Geographical restriction: Service availability is not restricted
- Content types: regular (fiction and documentary) films, short films, and films created with the help of artificial intelligence – so-called AI films, which are always visibly marked with an “AI” label
II. Prices and payment terms
- Prices are final; the operator is not a VAT payer
- VAT: Not charged – the operator is not a VAT payer
- Currency: Czech koruna (CZK)
- Payment methods:
- By payment card via the COMGATE gateway (VISA, Mastercard, Maestro)
- By bank button / bank transfer via the COMGATE gateway (including a QR code)
- As a backup – by direct bank transfer using a QR code via FIO bank; this option is activated by the platform operator as needed (especially during a temporary COMGATE gateway outage)
- Delivery costs: Digital delivery is free
💳 Payment gateway provider
Online payments are provided for us by the payment gateway Comgate. The service provider, Comgate a.s. is a licensed payment institution operating under the supervision of the Czech National Bank. Payments made through the payment gateway are fully secured and all information is encrypted.

📲 Backup payment by QR code via FIO bank
As a backup, films can also be paid for by direct bank transfer using a QR code via FIO bank. This method is activated by the platform operator as needed – especially during a temporary COMGATE payment gateway outage. In that case the access code is sent after the payment is credited to the account. The COMGATE gateway remains the main and recommended payment method.
III. Film access period
Depending on the settings of a particular film, the viewer can choose from one or two rental options:
- Monthly access (30 days) – the standard option available for all films.
- 24-hour access at a reduced price – offered only for films where the author enables it. If available, the viewer chooses at purchase whether to rent the film for 30 days or for 24 hours at a lower price.
The following applies to both options:
- The access period (both 30 days and 24 hours) is counted only from activation of the access code by the viewer, not from payment. The code can thus be purchased in advance and activated later.
- A rented film can be watched on up to two devices simultaneously.
- The viewer can purchase any number of films and rent a film again at any time – there is no need to wait for a previous rental to expire.
- The access code is intended for personal use only and must not be shared.
📺 Subscriptions – series and channels
In addition to one-off film rentals, the platform also offers subscriptions to series and channels – themed groups of films by a single creator, to which further episodes may be added over time. A subscription is a separate service alongside rentals; for a given series the viewer chooses whether to subscribe.
- Recurring monthly payment. The subscription is paid monthly by card through the COMGATE gateway as a recurring ("one-click") payment. By completing the first (initial) payment you consent to the recurring automatic charging for that subscription until you cancel it.
- Automatic renewal. The subscription renews automatically for a further month until you cancel it. We send you a confirmation e-mail for each payment made.
- Price. The price shown for a given series is the final price in Czech koruna (CZK) per one monthly period. The price agreed when the subscription starts remains unchanged for that subscription – any later change to the series price applies only to newly created subscriptions, not to running ones.
- Access via account. After payment we send your account login details to the e-mail provided. Access to the series content is tied to being signed in and having an active subscription – no access code is used for subscriptions.
- Growing content. For the duration of the subscription you have access to all published episodes of the series, including episodes the author adds later.
- Devices. Content may be watched on up to two devices at the same time. Login details are for personal use only and must not be shared.
- Cancel anytime. You can cancel anytime in the "📺 My subscriptions" section after signing in. Cancelling stops further renewals; access remains until the end of the period already paid for. No refund is given for the current (already paid) period.
- Failed payment. If a recurring payment cannot be processed (e.g. an invalid or expired card), we will retry it over the following days. If it still remains unpaid, the subscription ends after a grace period and access is revoked. We will notify you of a failed payment by e-mail.
Withdrawal from the contract. Article IV above applies to subscriptions as well. This is the provision of digital content for which, under Section 1837(f) of the Civil Code, the right of withdrawal ceases at the moment the content is made available (streaming begins) with your prior express consent. This does not affect your ability to cancel the subscription for the future at any time.
Complaints. Complaints regarding a subscription (e.g. playback not working through no fault of your connection, content not made available after a successful payment, non-delivery of login details) are handled under Article V above at reklamace@indiestream.cz.
IV. Withdrawal from the contract
Important notice: Under Section 1837(f) of Act No. 89/2012 Coll., the Civil Code, a contract for the provision of digital content cannot be withdrawn from if the content was not supplied on a tangible medium and was supplied with the consumer's prior express consent.
The right of withdrawal expires:
- Upon activation of the access code and the start of streaming

© VII. Copyright
All content is protected by copyright and international treaties on the protection of intellectual property.
Copyright in the films remains fully with their authors. IndieStream.cz acquires only a non-exclusive licence to make the works available to viewers through this platform; authors are therefore free to offer their works elsewhere (e.g. YouTube, Vimeo or other VOD services). This non-exclusive licence concerns solely the copyright (licensing) relationship between the author and the operator and does not affect editorial responsibility for the service. The operator of IndieStream.cz alone decides whether each programme is included in the catalogue, whether it is published, and whether it is removed, and bears editorial responsibility for the selection and organisation of the programmes. Authors do not publish or remove their programmes themselves; they may ask the operator to remove a work, and the operator is also entitled to remove content on its own initiative, in particular in the event of a breach of the terms of service or of the law.
By paying for the rental, the viewer obtains only a temporary and personal right to view the film (to stream it) on the IndieStream.cz platform. They do not acquire ownership of the work, a licence for its further use, or the right to download, copy or further distribute the film.
🎬 VIII. Short films and voluntary contributions
Short films (usually up to 15 minutes) are for viewers completely free and do not require purchasing an access code.
- Viewers can support the creator with a voluntary financial contribution. The contribution is entirely optional and does not create any entitlement to consideration.
- The same fair split applies to voluntary contributions to films as to paid rentals – 85% of the contribution goes to the author, 15% to the platform for operation and development.
Supporting the platform's operation (“Buy us a coffee”): In addition to supporting individual creators, viewers can also voluntarily contribute to the operation of the IndieStream.cz platform itself. This is a voluntary donation with no entitlement to consideration, used to cover the costs of operating and further developing the service.
🤖 AI films (content created by artificial intelligence)
The platform also offers films created wholly or partly with the help of artificial intelligence (so-called AI films). Every such film is, in the catalogue and in its detail, always visibly marked with an “AI” label, so that you know what kind of content it is before paying – in accordance with the European Union's Artificial Intelligence Regulation (the so-called AI Act, Art. 50).
- AI films are purchased and made available under the same conditions as regular films – including the access period, complaints procedure, and the right of withdrawal.
- The operator requires from AI film creators a declaration that they hold the rights to use the AI output and that the film does not infringe the copyright or personality rights of third parties.
If you have a question about the labelling or content of a specific AI film, contact us at podpora@indiestream.cz.
IX. Out-of-court resolution of consumer disputes
Consumer complaints are handled by the operator via email podpora@indiestream.cz. The operator will send information about the resolution of the complaint to the consumer's email address.
For out-of-court resolution of consumer disputes arising from a purchase or service contract, the competent body under Act No. 634/1992 Coll. on Consumer Protection is the Czech Trade Inspection Authority (ČOI). The consumer may turn to it if the dispute cannot be resolved directly with the operator.

X. Final provisions
- Non-exclusivity: Cooperation with creators is non-exclusive; authors may offer their works on other platforms as well
- Changes to the terms: We reserve the right to change these terms with prior notice
- Severability: The invalidity of part of the terms does not affect the validity of the remaining provisions
- Electronic communication: You agree to communication by electronic means
- Governing law: These terms and the relationships arising from them are governed by the law of the Czech Republic
By continuing to rent the film, you agree to these Terms & Conditions.
